Terms of Service for Brick Journey
Welcome to Brick Journey! These Terms of Service ("Terms") govern your use of our website located at www.brickjourney.com.au ("Site") and any related services provided by Brick Journey. By accessing or using our Site, you agree to abide by these Terms.
1. Acceptance of Terms
By accessing or using any part of our Site, you agree to be bound by these Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any services.
2. Eligibility
You must be at least 18 years of age or have the consent of a parent or guardian to use this Site. By using our Site, you represent and warrant that you are at least 18 years old or have permission from a parent or guardian.
3. Account Creation and Use
To place an order, you may be required to create an account. You agree to provide accurate, current, and complete information and to maintain the confidentiality of your account details. You are responsible for all activities that occur under your account.
4. Product Information and Pricing
Descriptions: We aim to ensure all product descriptions and images on our Site are accurate. However, slight variations may occur, including minor variations in product packaging or box condition.
Pricing: All prices are listed in AUD and include GST unless stated otherwise. We reserve the right to change prices and adjust them for sales, promotions, or errors.
5. Orders and Payments
Order Acceptance: All orders are subject to product availability. We reserve the right to refuse or cancel an order where reasonably necessary, including where a product is unavailable, incorrectly priced, or an obvious listing or pricing error has occurred. If payment has already been received for an order that we cancel, the applicable amount will be refunded.
Payment: We accept various payment methods displayed at checkout. Payments must be completed in full before an order is dispatched.
Order Cancellation: You may request cancellation of your order within 24 hours of purchase. Cancellation requests are not guaranteed once an order has entered processing or has been dispatched. Once an order has been shipped, it cannot be cancelled, but it may be eligible for a return under our Returns & Exchange Policy.
6. Shipping and Delivery
Shipping costs, available delivery services and estimated delivery timeframes are outlined in our Shipping & Delivery Policy.
Our current Australian shipping options include:

Orders under 3KG / 50cm: Standard shipping $19.99 or Express shipping $29.99.

Orders above 3KG / 50cm: Standard shipping $39.99.

Express shipping for orders above 3KG / 50cm will be confirmed by email.
If the applicable shipping fee has not been paid correctly, we may contact you by email to clarify and arrange payment of the applicable shipping amount before dispatch.
Delivery timeframes are estimates only and may be affected by courier delays, weather, remote locations, peak periods, or other circumstances beyond our reasonable control.
Nothing in this section limits your rights under the Australian Consumer Law where we fail to meet a consumer guarantee.
7. Returns and Exchanges
Our Returns & Exchange Policy provides details on change-of-mind returns, exchanges, damaged or defective products, and other return conditions.
For eligible change-of-mind returns, customers must request the return within 14 days of delivery and meet the conditions specified in our Returns & Exchange Policy.
A 10% restocking fee may apply to eligible change-of-mind returns. Original shipping/postage charges are generally non-refundable for change-of-mind returns, and the customer is responsible for return shipping costs.
These change-of-mind conditions do not apply where a product is faulty, defective, incorrectly supplied, or otherwise covered by the consumer guarantees under the Australian Consumer Law.
8. Consumer Guarantees
Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms or our other policies is intended to exclude, restrict or modify any rights or remedies available to consumers under the Australian Consumer Law.
9. Intellectual Property
All content, including images, text, logos, graphics, and designs on Brick Journey's Site are the intellectual property of Brick Journey or are used with appropriate permission. Unauthorized use, reproduction, modification, or distribution is prohibited.
10. Limitation of Liability
To the maximum extent permitted by law, Brick Journey is not liable for indirect, incidental, or consequential damages arising out of or related to the use or inability to use our Site.
Nothing in these Terms excludes, restricts, or modifies any liability or consumer right that cannot legally be excluded, restricted, or modified under applicable law.
11. Indemnification
You agree to indemnify and hold Brick Journey harmless from claims, damages, losses, liabilities, and expenses arising from your unlawful use of the Site, violation of these Terms, or infringement of the rights of a third party, except to the extent caused by Brick Journey's own unlawful conduct or where such indemnification is not permitted by law.
12. Changes to Terms
We reserve the right to update or modify these Terms from time to time. The "Last Updated" date at the top of this document indicates the latest revision date.
Changes will not affect rights or obligations that have already arisen under an order placed before the changes took effect.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia and the applicable laws of the State or Territory in which Brick Journey operates.
Nothing in these Terms limits any rights a consumer may have under applicable Australian consumer protection laws.
